Expert Witness Testimony

An expert witness’s paramount duty is to the court — not to the party who retains them. That independence is exactly what makes expert evidence valuable: evidence that holds up under cross-examination because it is impartial, methodologically sound, and defensible.

NSI Global provides credible, independent expert witness services to law firms and legal representatives across Australia. Our role is not to advocate for a position, but to give the court clear, factual, and admissible evidence in digital forensics, e-discovery, and information security matters — evidence that withstands scrutiny precisely because it is objective.

Our Expert Witness

NSI Global’s expert witness work is led by Navid Sobbi, who holds a Bachelor of Laws and postgraduate qualifications in Intelligence, Digital Forensics and Counterterrorism and has provided expert evidence in Criminal, Civil, and Family law proceedings. Navid’s fields of accepted expertise include mobile device forensics, computer forensics, e-discovery, cellular tower and location analysis, advanced digital forensics, counterintelligence, international security and transnational crime.

His evidence has been accepted in matters including Peek v Wheatley [2025] NSWSC 554 and Wheatley v Peek [2025] NSWCA 265.

When to Engage an Expert Witness

  • A matter turns on the interpretation of digital or forensic evidence
  • The opposing party has served an expert report that needs independent review
  • The court requires a technical question resolved by a qualified, impartial expert
  • Evidence must be presented in a form admissible and defensible under cross-examination

The Expert Witness Roles We Provide

Single Joint Expert

A single expert instructed jointly by both parties to provide independent evidence on an agreed question, reducing cost and narrowing the issues in dispute.

Court-Appointed Expert

An expert appointed by the court itself to assist it on technical matters, operating under direct duty to the court.

Shadow Expert

An expert engaged by one party to review, test, and advise on the opposing expert's evidence and methodology, without necessarily giving evidence themselves.

Expert Witness Affidavits & Reports

Sworn written evidence and formal expert reports prepared to the standard required by the relevant court or tribunal, including report reviews of another expert's findings.
